Code of Practice
The equity101 Code of Practice is intended to guide users of the equity101 website in understanding their responsibilities to act in good faith, and to maintain appropriate standards of professionalism, integrity, fairness and respect. This equity101 Code of Practice applies to all users. It reflects the values and principles guiding the provision of the equity101 website.
Users of the equity101 website must act with:
- professionalism
- integrity
- fairness
- respect for others
- in accordance with policies and purposes specified in Equity 101
The equity101 website is for:
- educational, professional and non-commercial purposes to enhance equity and social inclusion in higher education
Contributors to the equity101 website are expected to:
- make a positive contribution to equity and social inclusion in higher education
- foster constructive exchanges
Leaders of groups in the equity101 website are expected to:
- establish with group members the norms and practices for group dialogue and interaction
- encourage the open exchange of information and ideas
- ensure all contributions including email and forum postings uphold the equity101 Code of Practice and monitor the quality of contributions to ensure continuing compliance
- create a process for handling and resolving grievances
- bring unresolved grievances to the attention of the equity101 Content Manager.
Upon registration, users are required to indicate that they have read and agree to observe the Terms and Conditions of Use for their registration to be activated.
Users who have reason to believe that this equity101 Code of Practice has not been upheld may contact the equity101 Content Manager and/or notify a grievance.
Registration may be revoked if an individual or group fails to uphold this equity101Code of Practice
Content Removal
A. Policy statement
The Content Removal policy outlines the conditions under which content of the equity101 website will be removed if it is determined to be unsuitable.
Where the standard of content of the equity101 website is deemed to be unsuitable, the processes outlined in this Content Removal policy will be pursued.
The National Centre for Student Equity in Higher Education, University of South Australia reserves the right to remove content that it deems unsuitable.
(1) Notification
The National Centre for Student Equity in Higher Education, University of South Australia staff member who identifies any content considered to be potentially unsuitable is required to record and notify this using the procedures outlined in section B of this policy.
A user may notify the National Centre for Student Equity in Higher Education, University of South Australia of content they consider to be potentially unsuitable, using the procedures outlined in section B of this policy. Such notifications will be treated as confidential.
(2) Reasons for content being deemed unsuitable
Content may be deemed to be unsuitable for different reasons, including but not limited to the following:
(a) The content contravenes the equity101 Code of Practice or other Policies
(b) The content is not of sufficient quality to meet the standards set out in the equity101 Code of Practice policy
(c) The content violates the intellectual property rights of a third party
(d) The content is for primarily commercial rather than educational purposes.
(3) Membership rights
A user who contributes content deemed to be highly unsuitable in not conforming to the equity101 Code of Practice policy may have their membership revoked.
B. Procedures
(1) Determinations on suitability of content
The equity101 Content Manager will be responsible for reviewing content notified as being potentially unsuitable, and ensuring a rapid determination and resolution of the matter, using the procedures outlined in this policy. Where the equity101 Content Manager requires further advice to resolve a matter other relevant University of South Australia support services will be sought. In cases of copyright infringement disputes, the Copyright Officer of the University of South Australia will follow the established UniSA Copyright Infringement Take-Down Procedure.
(2) Notification of content considered to be unsuitable
Notifications of content considered to be unsuitable will be treated in confidence.
(a) Notification by UniSA staff
A staff member who considers content to be unsuitable is required to record the instance, providing sufficient detail for the content to be located (for example, title, url, date of publication, according to the type of content), and the date on which the content was viewed. All reasonable attempts should be made to provide this record of notification to the equity101 Content Manager within 1 working day of identifying a possible problem.
(b) Notification By users
A user wishing to notify an instance of content on equity101 website that they consider to be unsuitable may report their concerns via email (mailto:SiteAdmin@equity101.info):
The notification should include sufficient detail for the content to be located (for example, title, url, date of publication, according to the type of content), the date on which the content was viewed by the user, and the users contact details.
If the notification relates to copyright infringement, the notice must contain additional information to allow UniSA’s Copyright Office to investigate the alleged infringement on behalf of the copyright owner including:
- A description of the work to which the claim refers
- The location of the alleged infringement (IP address, URL, network address)
- A statement in good faith that use of the material has not been authorised by the copyright owner or their representative
- Sufficient information to enable UniSA to contact the copyright owner or their representative.
When sending notifications to the copyright owner or agent, the University is permitted to include information that may identify the user.
Where insufficient information is provided UniSA will take all reasonable steps to obtain sufficient information to allow investigation of the claim.
(c) Determination on suitability of content
When content is notified as being considered unsuitable, the equity101 Content Manager will review the content in order to determine its suitability. This review will normally occur within 24 hours of the notification having been received. The review will be carried out using the equity101 Code of Practice and other Policies as a point of reference. A record will be made of the determination, including its rationale based on these policies.
(d) Actions following a determination
In cases where content is deemed to be unsuitable, the equity101 Content Manager will:
- expeditiously hide the content from public access
- contact the contributor of that content to outline the reason for the notification, and to invite the contributor to reconsider the content
- liaise with the contributor of the content to resolve the matter
- where contributors publish commercial content or use equity101 website to publish spam, hide content from the public and revoke the contributor's account without notification
In cases where the suitability of the content is contentious, the equity101 Content Manager will bring the matter to the attention of the relevant National Centre for Student Equity in Higher Education, University of South Australia staff for resolution.
A user who notifies the equity101 Content manager of the potential unsuitability of some content on the equity101 website will only be provided with feedback on the outcome of the investigation where the user is directly affected (for example, where the user believes that their intellectual property rights have been infringed).
A user who contributes content deemed to be highly unsuitable in not conforming to the equity 101 Code of Practice policy may have their membership revoked.
C. Definitions
For the purposes of this policy, “content” is defined to comprise different types of material including resources, commentary on resources, discussions, and web pages. Content may include items which are held within equity101, and items which are held elsewhere, for example, in external websites or collections, but are linked to from within equity101.
Registration and Access
Membership of the service is open to all interested in equity and social inclusion in higher education and who agree to the Terms and Conditions of Use.
The Access and Registration policy outlines the terms and conditions associated with making a contribution to, and/or participating in, equity101.
Membership of equity101 is available to individuals or groups with an interest in equity and social inclusion in higher education.
Without registering, a user may:
- browse equity101to locate resources
- search equity101 to locate resources
- view some content of groups
- download some files
Registered users may, in addition to the above:
- contribute comments on content
- contribute ratings on content
- join a group
- invite someone to join a group
- set up a group
- contribute a resource
All members of a group must register individually.
When a person registers, their email address will be validated, and personal information will be treated in accordance with equity101 Privacy Policy. All users of equity101, whether registered or not, are expected to uphold the Code of Practice. Upon registration with equity101, users are required to indicate that they have read and agree to observe the Code of Practice before their registration is activated.
A registered user who has not logged in for a period longer than 12 months will be sent a notice advising that their registration will be stopped and their My101 profile blocked unless they log in within the following month. Inactive users whose registration has been stopped may re-register at any time.
A group which has been inactive for a period longer than 12 months will be sent a notice advising that their group will be deleted and all the groups data archived unless they become active within the following month. Archived group data will be deleted permanently after a further 12 months.
A user’s membership of equity101 may be revoked for violations of the Code of Practice or other equity101 policies.
Terms and Conditions
Your access to, and use of the material, information or publications available through the Equity 101 website is conditional on your acceptance and compliance with the following terms and conditions:
(1) The National Centre for Student Equity in Higher Education, University of South Australia accepts no liability or responsibility for any loss or damage whatsoever suffered as a result of use of the Equity 101 website.
(2) Users contributing to the equity101 website are bound by Creative Commons Licensing arrangements. This work is licensed under the Creative Commons Attribution-Noncommercial-Share-Alike 2.5 Australia License. To view a copy of this license, visit http://creativecommons.org/licenses/by-nc-sa/2.5/au/
(3) In relation to any material contributed by you:
(a) You grant the National Centre for Student Equity in Higher Education, University of South Australia a perpetual, irrevocable, royalty-free, fee-free, non-exclusive licence to use, reproduce, modify, adapt, publish, sublicense, create derivative works from and incorporate in other works that material at any time in the future, in any form and for any purpose;
(b) You warrant that you are, or will be at the relevant time, entitled to deal with the intellectual property rights in the material, including any embedded third party material;
(c) You warrant that the receipt of the material by the National Centre for Student Equity in Higher Education, University of South Australia is not illegal or defamatory and will not expose the National Centre for Student Equity in Higher Education, University of South Australia to any civil or criminal liability, including but not limited to a warranty that the material is not misleading or deceptive or likely to mislead or deceive;
(d) You indemnify the National Centre for Student Equity in Higher Education, University of South Australia for any breach of the warranties contained in 3(b) and 3(c) above.
(4) Use of the Equity 101 website is expected to be undertaken for educational, professional, personal and non-commercial purposes and in compliance with the Code of Practice.
(5) The National Centre for Student Equity in Higher Education, University of South Australia will remove from the Equity 101 website any contributions that do not conform to clause 4. See Content Removal.
(6) The National Centre for Student Equity in Higher Education, University of South Australia makes no representation that the material, information or publications made available through or on the Equity 101 website complies with the laws (including intellectual property laws) of any country outside Australia. Access to the Equity 101 website from outside Australia is the users responsibility and the user is responsible for ensuring compliance with all laws in the place where the Equity 101 website is accessed.
(7) The National Centre for Student Equity in Higher Education, University of South Australia may at any time without notice immediately terminate your use and access to the Equity 101 website. In the event of termination, the user is no longer authorised to use or access the equity101 website. All restrictions imposed on the user and all disclaimers and limitations of liability set out in the Terms and Conditions of Use, the Disclaimer, the Copyright Statement, the Privacy Statement and the Code of Practice survive the termination.
Your use of, and access to, the equity101 website constitutes your agreement to the Terms and Conditions of Use. The National Centre for Student Equity in Higher Education, University of South Australia reserves the right to vary these Terms and Conditions at any time without prior notice to you.
